In 1986 a historic court case was decided by the Supreme Court: Bowers v. Hardwick ruled that homosexual sodomy is not a fundamental right, and states were deemed to have the right to criminalize it so long as the statute or ordinance doing so has a rational reason that the law protects state interests.
